Conditions of Hire for Gingerbread Cottage, Bakewell

  1. In these Conditions of Hire: the "Lead Guest" refers to the person so named on the Booking Form; "Guests" refers to those persons named on the Booking Form; "the premises" refers to Gingerbread Cottage including the garden; and “the Owners” refers to the owners of Gingerbread Cottage, Nigel and Lisa Sanderson.
  2. A non-refundable deposit of £100 is payable on all bookings made more than 8 weeks in advance of the start date of the holiday. The balance is due 6 weeks before the start date.
  3. For bookings made less than 6 weeks before the start date of the holiday, the full holiday cost is payable on booking.
  4. Upon receipt of the Booking Form by the Owners, the Lead Guest is liable for payment of the balance of the holiday cost. In the event of cancellation of the holiday by the Guests for whatever reason, the full balance shall remain payable unless the premises is re-let for those same holiday dates. In any event the deposit of £100 is not returnable. It is therefore recommended that Guests arrange holiday insurance.
  5. The maximum occupancy of Gingerbread Cottage is not to exceed 4 + 1 child/infant on pull out bed or cot (not provided).
  6. Gingerbread Cottage is for the sole use of those people named on the booking form.
  7. Lettings start at 3.00pm on the day or arrival, and end at 10.00am on the date of departure. Please abide by these times so that the premises may be fully cleaned for both you and subsequent guests.
  8. Smoking is prohibited throughout Gingerbread Cottage, including the garden.
  9. Heating and electricity is included. Bed linen and towels are provided.
  10. Guests are requested to inform of any breakages or damage and to replace or make good if possible or to leave adequate funds to do so.
  11. Guests will not make any alterations or additions to Gingerbread Cottage the decorations or furniture and will keep and leave the premises and the furniture clean and tidy and in the same state of repair and condition as they are in on the start date.
  12. Guests will not do anything on the premises which may be or tend to be a nuisance or annoyance or cause damage to the owners or occupiers of any neighbouring or adjoining property.
  13. Guests will use the premises for the purpose only of a private holiday residence for the number of persons indicated on the Booking Form for the duration of the holiday shown on the Booking Form and the owners reserve the right to withhold and/or withdraw the keys of the premises if such number is exceeded. The Guests will not assign sub let or part with or share possession of the premises or any part of them under any circumstances whatsoever.
  14. Guests will permit the owners or their representatives to have access to the premises at all reasonable times.
  15. Guests will return the keys to the premises on departure. In the event of failure to do so, the Guests are liable for payment on demand of the full cost of any replacement key and/or locks to the premises.
  16. A Parking Permit is provided which permits parking in the Residents Only bays above and below Gingerbread Cottage. The Parking Permit should be prominently displayed on your car dashboard. The Parking Permit must be left in the property upon departure at 10am. In the event of failure to do so, Guests will be responsible for any costs incurred, including the cost of any replacement permit and/or the costs of reimbursing subsequent holiday guests for their parking costs.
  17. Except in respect of death or personal injury caused by the Owners negligence or that of our employees or agents, the Owners shall not be liable to the Guests for any loss or damages occurring to the Guests as a result of or in connection with the hire of the premises.
  18. One well behaved dog is permitted downstairs only at the premises by prior arrangement only and at an additional charge of £20 per week. Pets are not permitted upstairs at the premises and should not be left unattended at the premises including the garden. Pets are not permitted to foul the garden and are not permitted onto the furniture.
  19. The Guests will have the right to occupy the premises for a holiday within the meaning of the Housing Act 1988 (Schedule 1, paragraph 9) and the Guests acknowledge that the tenancy granted by this Agreement is not an Assured Tenancy and that no statutory periodic tenancy will arise on the determination of the holiday.
  20. These Conditions of Hire and the Booking Form constitute the whole contract between the Guests and the Owners. This contract is governed by English Law and all matters arising under it or in relation to it are to be submitted to the exclusive jurisdiction of the English courts.
